The short version

PolyScalping is an analytics and order-construction interface. We do not custody your funds, do not execute or match orders, and do not provide financial advice. By using the Interface you accept the risks of prediction-market trading, smart-contract failure, and third-party service dependencies — and you agree to the full Terms below. Read them.

1. Acceptance of Terms

These Terms of Use (the "Terms") form a binding legal agreement between you and PolyScalping ("PolyScalping", "we", "our", or "us") governing your access to and use of the polyscalping.org website, any associated subdomains, software, APIs, and related services we may make available (collectively, the "Interface"). By accessing or using the Interface, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to any part of these Terms, you must not access or use the Interface.

2. Definitions

  • Interface — the polyscalping.org website and any associated software, tools, dashboards, APIs, and content we provide.
  • Polymarket — the prediction-market protocol and central-limit-order-book exchange operated by third parties on the Polygon network. PolyScalping is not affiliated with, endorsed by, or operated by Polymarket.
  • Third-Party Services — any external service, protocol, network, smart contract, or infrastructure relied on by the Interface, including but not limited to Polymarket's CLOB and Gamma APIs, fun.xyz cross-chain bridging, the Polygon network, the Telegram API, and any oracle or relayer.
  • Digital Assets — cryptocurrencies, stablecoins, conditional tokens, and any other blockchain-based assets you hold, transfer, or transact with through the Interface.
  • Dispute — any claim, dispute, or controversy between you and PolyScalping arising out of or relating to these Terms or the Interface, whether in contract, tort, statute, fraud, misrepresentation, or any other legal theory.

3. Eligibility

By accessing or using the Interface you represent and warrant that:

  • You are at least eighteen (18) years old and have the legal capacity to enter into a binding contract in your jurisdiction.
  • You are not located in, ordinarily resident in, accessing the Interface from, or a national of any Prohibited Jurisdiction listed in Section 4.
  • You are not, and are not acting on behalf of any person or entity that is, the subject of any sanctions administered or enforced by the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC), the United Nations Security Council, the European Union, His Majesty's Treasury, or any other applicable governmental authority.
  • Your access to and use of the Interface is not unlawful under the laws of your jurisdiction.
  • You have not been previously suspended or removed from the Interface or any analogous service.

4. Geographic Restrictions

You represent and warrant that you are not located in, ordinarily resident in, organized in, or accessing the Interface from any of the following jurisdictions (each a "Prohibited Jurisdiction"):

Australia, Belarus, Belgium, Burundi, the Central African Republic, the Crimea, Donetsk, and Luhansk regions of Ukraine, Cuba, the Democratic Republic of the Congo, Ethiopia, France, Germany, Iran, Iraq, Italy, Japan, Lebanon, Libya, Myanmar, the Netherlands, Nicaragua, North Korea, the Province of Ontario (Canada), Poland, Russia, Singapore, Somalia, South Sudan, Sudan, Syria, Taiwan, Thailand, the United Kingdom, the United States of America (including its territories and possessions), Venezuela, Yemen, Zimbabwe — and any other jurisdiction in which access to or use of the Interface would be unlawful, restricted, or require licensing we do not hold.

We may, in our sole discretion, add or remove jurisdictions from this list at any time, including in response to changes in applicable law or in our risk assessment.

Polymarket eligibility delegation. Trading, deposit, and withdrawal functionality available through the Interface is conditional upon the user's eligibility as determined by Polymarket and its associated services. The Interface mirrors Polymarket's geographic-eligibility determinations: where Polymarket blocks a user from trading, the Interface restricts the corresponding functionality. We make no independent determination of eligibility for downstream trading, and any block or allow result returned by Polymarket's geoblock endpoint may differ from the enumeration above as Polymarket's policies evolve.

Read-only access. Public market data, leaderboards, blog content, and other informational surfaces of the Interface remain accessible globally, subject to applicable law. Read-only access does not constitute trading, market access, or solicitation, and is not subject to the trading-eligibility restrictions in this Section.

Anti-circumvention. You agree not to use a virtual private network (VPN), proxy server, Tor, or any other tool or technique to misrepresent your geographic location or to circumvent these restrictions. Doing so is a material breach of these Terms and may constitute a violation of applicable law.

5. Sanctions Compliance

You represent, warrant, and covenant that (i) you, any beneficial owner of your wallet, and any person you are acting on behalf of, are not on the OFAC Specially Designated Nationals (SDN) list or any equivalent list maintained by the European Union, the United Nations Security Council, His Majesty's Treasury, or any other applicable authority; (ii) you will not use the Interface to transact with any sanctioned person, entity, or jurisdiction; and (iii) you will not attempt to transmit, exchange, or otherwise interact with funds derived from criminal activity, money laundering, terrorism financing, or other unlawful sources. We reserve the right, in our sole discretion, to block, restrict, or terminate access for any wallet address or user we reasonably believe is in violation of this Section.

6. Description of the Interface

  • The Interface is a software tool that displays publicly available data about the Polymarket prediction-markets protocol and helps users construct transactions for submission to Third-Party Services.
  • PolyScalping is not a broker, dealer, exchange, market-maker, swap-execution facility, designated contract market, money-services business, or money transmitter.
  • PolyScalping does not custody, hold, control, or transmit user funds, private keys, seed phrases, or wallet credentials. All transactions are constructed by you in your wallet, signed by you, and submitted to Third-Party Services that you choose.
  • PolyScalping does not execute, match, clear, settle, or route orders. Order matching and settlement occur on Polymarket's CLOB and on the Polygon network, both operated by parties unaffiliated with PolyScalping.
  • All content, data, calculations, and tools provided through the Interface are for informational and educational purposes only. Nothing in the Interface constitutes investment, financial, legal, tax, accounting, or other professional advice.

7. User Responsibilities and Prohibited Conduct

You are solely responsible for the security of your wallet, private keys, seed phrases, devices, and any other access credentials. We have no ability to recover, reset, or restore access to your wallet or to reverse any transaction.

You agree not to, and not to assist any third party to:

  • Use the Interface in violation of any applicable law, regulation, or these Terms.
  • Use the Interface for any fraudulent, deceptive, manipulative, market-abusive, or unlawful purpose, including but not limited to wash trading, spoofing, front-running, layering, or any other manipulative practice prohibited by applicable financial-market regulations.
  • Attempt to access, hack, reverse-engineer, decompile, disassemble, or derive the source code of any portion of the Interface not made publicly available.
  • Use any robot, spider, scraper, automated tool, or process to access the Interface in a manner that imposes unreasonable load on our infrastructure or third-party infrastructure we rely on.
  • Impersonate any person or entity, misrepresent your identity, or use a forged or unauthorized wallet, email, identifier, or other credential.
  • Use the Interface to transmit any virus, worm, Trojan horse, ransomware, or other malicious code.
  • Use the Interface to interact with, deposit to, or withdraw from any wallet address or smart contract associated with sanctioned persons or unlawful activity.
  • Resell, sublicense, or commercially redistribute access to the Interface or any portion of its content without our prior written consent.

We reserve the right, in our sole discretion and without notice, to suspend, restrict, or terminate your access to the Interface for any conduct we reasonably believe violates these Terms or applicable law.

8. Risk Acknowledgment

You expressly acknowledge, accept, and assume the following risks. This list is not exhaustive — additional risks may exist that are not addressed here. By using the Interface you agree that PolyScalping shall have no liability for any loss arising from any of these risks.

  • Market risk: prediction-market positions are highly speculative. You may lose the entire amount you commit to any position. Past performance of any market or strategy is not indicative of future results.
  • Smart-contract risk: the smart contracts you interact with — including those of Polymarket, fun.xyz, the Polygon network, and any oracle — may contain bugs, vulnerabilities, design flaws, or be subject to exploits, governance attacks, or upgrades that result in total loss of funds.
  • Oracle and resolution risk: prediction-market outcomes depend on third-party oracles and resolution sources. Incorrect, delayed, manipulated, or unresolved outcomes may result in loss.
  • Bridging risk: cross-chain bridges, including fun.xyz, may experience delays, fail to settle, be exploited, or be censored. Funds in transit are not under our control and are governed by the terms of the bridging provider.
  • Network and infrastructure risk: blockchain networks may experience congestion, forks, reorganizations, downtime, censorship, or 51% attacks. RPC providers, indexers, hosting providers, and content delivery networks may fail or be censored.
  • Key-loss risk: if you lose access to your private keys or seed phrase, your funds are unrecoverable. We have no ability to assist with recovery.
  • Cryptographic and quantum risk: cryptography is a progressing field. Advances such as the development of quantum computers, or the discovery of cryptanalytic attacks against currently-used primitives, may compromise the security of Digital Assets or of the transactions you sign.
  • Regulatory risk: the legal status of prediction markets, conditional tokens, and Digital Assets generally varies by jurisdiction and is evolving. Regulators may take action against Polymarket, fun.xyz, the Polygon network, or any other Third-Party Service, which may affect your ability to access funds or positions.
  • Tax risk: you are solely responsible for determining the tax treatment of your activity and for reporting and paying any taxes due in your jurisdiction.
  • Operational risk: the Interface may experience downtime, bugs, data errors, or be modified, suspended, or discontinued at any time without notice. Information displayed may be inaccurate or outdated.

9. Third-Party Services

  • The Interface is a client layer that displays data from and constructs transactions for submission to Third-Party Services. PolyScalping does not custody user funds, does not operate market-making infrastructure, and does not settle trades itself.
  • Deposits and withdrawals are bridged by fun.xyz, which generates deposit addresses, prices any cross-chain swap, and delivers funds to the destination address. Settlement on Polygon is forwarded by a Polymarket relayer (relayer-v2.polymarket.com) and trades are executed against the Polymarket CLOB. Address lookups for deposits use the Polymarket Bridge API.
  • Market data, event metadata, and pricing come from the Polymarket Gamma and CLOB APIs. Optional user-side notifications are delivered through the Telegram API.
  • PolyScalping makes no representation or warranty, express or implied, with respect to any Third-Party Service. We are not responsible for the accuracy, availability, reliability, pricing, security, custody, fund-handling, settlement, or any other behaviour of any Third-Party Service. A failure, downtime, exploit, change of terms, regulatory action, or cessation of operation in any Third-Party Service may affect your ability to access, transfer, deposit, withdraw, or trade through the Interface — and we shall have no liability for any resulting loss.
  • Your use of any Third-Party Service is subject to that service's own terms and privacy policy. By initiating any deposit, withdrawal, or trade, you accept that the funds and positions in transit are governed by the terms of the upstream provider, not by these Terms.

10. Intellectual Property

All content, design, code, branding, trademarks, and documentation provided through the Interface, except where explicitly licensed under an open-source license or sourced from Third-Party Services, are owned by PolyScalping or our licensors. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Interface for your personal, non-commercial use. No other rights are granted by implication, estoppel, or otherwise.

11. Disclaimer of Warranties

THE INTERFACE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS, AND WITHOUT WARRANTIES OF ANY KIND.

To the maximum extent permitted by applicable law, PolyScalping disclaims all express, implied, and statutory warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, title, accuracy, completeness, uninterrupted availability, freedom from defects, freedom from viruses or other harmful components, and any warranties arising from a course of dealing, course of performance, or trade usage. We make no representation that any information, calculation, signal, or recommendation displayed through the Interface is accurate, current, complete, or suitable for your purposes.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL POLYSCALPING'S AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE INTERFACE (WHETHER IN CONTRACT, TORT, STATUTE, FRAUD, MISREPRESENTATION, OR ANY OTHER LEGAL THEORY) EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100.00 USD) OR (B) THE AMOUNT OF FEES YOU HAVE PAID DIRECTLY TO POLYSCALPING IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

IN NO EVENT SHALL POLYSCALPING BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, DIGITAL ASSETS, OR USE, ARISING OUT OF OR RELATING TO THESE TERMS OR THE INTERFACE, EVEN IF POLYSCALPING HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU IN FULL.

13. Indemnification

You agree to defend, indemnify, and hold harmless PolyScalping and its officers, directors, employees, contractors, agents, affiliates, and representatives (each an "Indemnified Party") from and against any and all claims, demands, actions, proceedings, investigations, liabilities, damages, losses, judgments, fines, penalties, costs, and expenses, including reasonable attorneys' fees and disbursements, arising out of or relating to (a) your access to or use of the Interface; (b) your violation of these Terms; (c) your violation of any applicable law, regulation, or order; (d) your violation of any right of any third party; (e) any User Content, feedback, suggestion, or communication you provide; or (f) any dispute between you and a third party arising in connection with your use of the Interface or any Third-Party Service. PolyScalping reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you.

14. Modification of Terms

We may modify these Terms at any time in our sole discretion by posting the revised version on the Interface and updating the "Last updated" date above. Material changes will be flagged by a notice on the Interface for at least seven (7) days after the effective date. Your continued access to or use of the Interface after the effective date constitutes your binding acceptance of the revised Terms. If you do not agree to any modification, your sole remedy is to stop accessing and using the Interface.

15. Termination

We may suspend, restrict, or terminate your access to all or any portion of the Interface at any time, with or without cause, with or without notice, and without liability. We may also modify, suspend, or discontinue the Interface, in whole or in part, at any time and without notice. Upon termination, all provisions of these Terms that by their nature should survive termination shall so survive, including without limitation provisions regarding intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution.

16. Governing Law

These Terms shall be solely and exclusively governed, construed, and enforced in accordance with the laws of the British Virgin Islands, without regard to its conflict-of-laws principles or to the United Nations Convention on Contracts for the International Sale of Goods.

17. Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT REQUIRES YOU TO RESOLVE DISPUTES WITH POLYSCALPING THROUGH BINDING INDIVIDUAL ARBITRATION RATHER THAN IN COURT AND WAIVES YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION.

17.1 Informal Resolution

Before commencing arbitration, you agree to first send written notice of any Dispute to polyscalping@gmail.com describing the Dispute, the relief sought, and your contact information. You and PolyScalping agree to attempt in good faith to resolve the Dispute informally for at least thirty (30) days after such notice is received. Only if the Dispute is not resolved within that period may either party commence arbitration.

17.2 Binding Arbitration

Any Dispute that is not resolved through informal resolution shall be finally and exclusively resolved by binding arbitration administered by JAMS in accordance with the JAMS International Arbitration Rules in effect at the time of commencement. The arbitration shall be conducted by a single arbitrator, in English, with the seat of arbitration in Road Town, Tortola, British Virgin Islands. Judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction. The arbitrator shall have exclusive authority to resolve any Dispute, including the arbitrability of any claim, except as expressly provided in Section 17.3.

17.3 Class Action Waiver

YOU AND POLYSCALPING AGREE THAT ANY DISPUTE IS PERSONAL BETWEEN YOU AND POLYSCALPING AND SHALL BE RESOLVED SOLELY THROUGH INDIVIDUAL ARBITRATION. ANY DISPUTE WILL NOT BE BROUGHT AS A CLASS ARBITRATION, CLASS ACTION, COLLECTIVE ACTION, PRIVATE ATTORNEY-GENERAL ACTION, CONSOLIDATED ACTION, OR ANY OTHER TYPE OF REPRESENTATIVE PROCEEDING. NEITHER YOU NOR POLYSCALPING WILL SEEK TO HAVE ANY DISPUTE HEARD AS A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.

Disputes regarding the interpretation, applicability, or enforceability of this Section 17.3 may be resolved only by a court of competent jurisdiction and not by the arbitrator. If this Section 17.3 is held unenforceable as to any particular claim, then that claim shall be severed and resolved in a court of competent jurisdiction, while all other claims shall remain subject to arbitration.

17.4 Injunctive Relief

Notwithstanding the foregoing, either party may bring a claim in a court of competent jurisdiction for injunctive or other equitable relief to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property, confidentiality, or sanctions obligations.

18. Force Majeure

PolyScalping shall not be liable for any failure or delay in performing any obligation under these Terms, or for any loss or damage you may incur, due to any cause or circumstance beyond our reasonable control, including without limitation acts of God, natural disasters, pandemic, war, civil unrest, terrorism, sabotage, government action, regulatory action, sanctions, court order, embargo, blockchain network failure or congestion, smart-contract exploit, oracle failure, RPC or hosting provider failure, internet outage, telecommunications failure, power outage, or denial-of-service attack.

19. General Provisions

  • Entire agreement. These Terms (together with any policies referenced herein, including the Privacy Policy) constitute the entire agreement between you and PolyScalping regarding the Interface and supersede all prior or contemporaneous communications and proposals, whether oral or written.
  • Severability. If any provision of these Terms is held by a court of competent jurisdiction or arbitrator to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it enforceable.
  • No waiver. No failure or delay by PolyScalping in exercising any right under these Terms shall operate as a waiver of that right, nor shall any single or partial exercise preclude any further exercise of that right.
  • Assignment. You may not assign, transfer, or delegate any of your rights or obligations under these Terms without our prior written consent, and any attempted assignment without such consent shall be void. PolyScalping may assign or transfer its rights and obligations under these Terms without restriction.
  • No agency. No agency, partnership, joint venture, employer-employee, or franchisor-franchisee relationship is created by these Terms.
  • Notices. We may provide notices to you by posting on the Interface, by displaying a banner, or by sending email to any address you have provided. You shall provide notices to us by email to polyscalping@gmail.com.
  • Language. These Terms are drafted in English. Any translation is provided for convenience only. In the event of any conflict between the English version and any translation, the English version shall prevail.
  • Headings. Section headings are for convenience only and do not affect interpretation.
